General Terms and Conditions

For a Tourist Pitch

The general terms and conditions apply to all agreements between the operator and the guest regarding the use of a tourist pitch. They are intended to regulate the rights and obligations of both parties.

Article 1: Definitions

  • The operator (Mini Camping Het Stammeland): The owner or manager of the campsite who provides the tourist pitch to the guest.
  • Guest:The person who enters into an agreement with Mini Camping Het Stammeland for the use of a tourist pitch.
  • Co-guest:The other person(s) listed in the agreement.
  • Third party:Any person other than the operator, guest, or co-guest.
  • Camping equipment:A tent, caravan, folding trailer, camper, etc.
  • Tourist pitch:A designated place made available for a camping unit for a maximum period of three months for recreational use, as specified in the agreement.
  • Agreement:The written or electronic agreement between the operator and the guest, specifying the use of a tourist pitch.
  • Agreed price:The fee paid for the use of the tourist pitch.
  • Cancellation:: Een schriftelijke beëindiging van de overeenkomst voor de ingangsdatum of tijdens het verblijf.
  • Information:Written or electronically provided details about the use of the tourist pitch, camping equipment, facilities, and other (house) rules of Mini Camping Het Stammeland.
  • Dispute:If a complaint submitted to the operator by the guest is not resolved to the satisfaction of the parties.

Article 2: Formation of the Agreement

The agreement is concluded when the operator has confirmed the reservation in writing. The operator can only confirm a reservation when the guest has submitted a reservation request in writing, for example, via the website or email.

Article 3: Content of the Agreement

  • The agreed tourist pitch is provided by the operator solely for recreational purposes and not for temporary habitation.
  • The operator is obligated to provide the information that forms part of the agreement in advance to the guest.
  • If the information significantly deviates from the information provided when the agreement was made, the guest has the right to cancel the agreement without incurring any costs.
  • The use of the tourist pitch is strictly for the guest and any co-guest(s) as specified in the agreement. Providing the tourist pitch to third parties, such as visitors or guests, is not permitted without written permission from the operator. Subletting is prohibited.
  • The guest is responsible for complying with the agreement and the operator's (house) rules. The guest must also ensure that any co-guest(s) or third parties who visit or stay with them also comply with the agreement and the (house) rules.
  • The operator provides the guest with a specific tourist pitch for the agreed period. The guest may indicate a preference for a tourist pitch, but the operator retains the right to change the assigned pitch to another tourist pitch until the start of the stay.
  • The guest may replace the camping unit with another unit of the same type, size, and weight but must inform the operator of this change in writing.

Article 4: Duration of Stay and Use

The tourist pitch is provided only for the specified dates of the reserved period. Any changes to the arrival or departure dates may only be made with the operator's permission. 

Article 5: Prices

  • The price for the use of the tourist pitch is determined in advance and can be found in the reservation confirmation. It is clearly stated what is included and what is not included in this price. This includes electricity usage, sanitation, hot and cold water, WiFi, and tourist tax.
  • If additional costs arise after the price has been established due to an increase in charges or levies directly related to the pitch, the camping unit, or the guest, these costs may, even after the agreement has been concluded, be passed on to the guest.

Article 6: Payment

  • The guest is obliged to make the payment in euros within the agreed payment term. The specific payment term and the associated payment conditions will be stated in the reservation confirmation. The guest must comply with these terms unless otherwise agreed in writing with the operator. Payments can be made using the specified methods, such as bank transfer or an online payment link.
  • If the reservation is made more than six weeks before the arrival date and the guest fails to fulfill their payment obligation, despite receiving a written reminder, within two weeks after receiving the reminder, the operator reserves the right to immediately cancel the agreement. This does not affect the operator's right to receive the full agreed amount.

Article 7: Cancellation

In case of cancellation by the guest, the following cancellation conditions apply:

  • More than three months before arrival: 15% of the agreed price.
  • Between three and two months before arrival: 50% of the agreed price.
  • Between two and one month before arrival: 75% of the agreed price.
  • Less than one month before arrival: 90% of the agreed price.
  • On the arrival date or in case of no-show: 100% of the agreed price.

If the operator cancels the agreement, the amount already paid by the guest will be fully refunded unless the termination is due to a fault or negligence by the guest. For example, when the guest repeatedly violates the behavior rules despite warnings.

Article 8: Code of Conduct for the Campsite

The guest, their fellow guests, and third parties must comply with the agreements in the contract, the campsite's (house) rules, and applicable government regulations. Failure to adhere to these rules may result in the termination of the agreement, in accordance with the procedure described below.

  • Disturbance and Disruption: It is not permitted to cause disturbance to other guests, staff, or residents. Any behavior that disrupts the atmosphere and safety of the site will not be tolerated.
  • Use of the Tourist Pitch and Camping Equipment: The tourist pitch and camping equipment are only to be used for recreational purposes. Misuse or improper use may lead to immediate termination of the agreement.
  • Safety Requirements: Camping equipment must meet generally accepted safety standards. In case of deficiencies that pose a risk to safety, the operator reserves the right to take measures, including terminating the agreement if necessary.
  • Procedure for Violations: If a violation occurs, the guest will receive a written or oral warning. In case of serious or repeated violations, the operator may terminate the agreement with immediate effect. In urgent cases, a warning may be omitted.
  • Evacuation and Departure: After termination of the agreement, the guest is obliged to vacate the pitch and camping equipment within a reasonable time, no later than 4 hours after termination. If this does not happen, the operator has the right to clear the pitch at the guest's expense.

Article 9: Pets

  • A maximum of two pets are allowed per tourist pitch, excluding visiting pets.
  • Pets must always be kept on a leash. This means that the leash must be attached to both the pet and a fixed object or a person. It is not permitted to set up a dog kennel or similar structure on the campsite.
  • The operator has the final authority to determine whether the leash requirements and pet behavior are being followed. This interpretation is binding and not open to dispute.
  • The guest is fully responsible for the behavior and safety of their pet(s) and any visiting pet(s). This includes any damage, disturbance, or injury caused by the pet to other guests, staff, or third parties interacting with the animal. The guest must ensure the pet does not cause inconvenience to others.
  • Failure to comply with these rules may result in the operator taking appropriate measures, ranging from a warning to the termination of the agreement.

Article 10: Liability

The operator is not liable for loss, damage, or theft of the guest's property, unless the damage is a result of the operator's intent or gross negligence.

The guest is liable for any damage caused by themselves, their fellow guests, third parties such as visitors, and pets. This applies to damage to the camping pitch as well as damage to other facilities on the campsite.

Article 11: Maintenance and Green Areas on the Campsite

The operator is responsible for maintaining the tourist pitches and the general facilities on the campsite, such as sanitation, greenery, electricity, and water connections. The guest is not permitted to make alterations to the tourist pitch or campsite, such as digging trenches, erecting fences, or creating gardens.
